Kern has gained state and national recognition for his representation of victims of catastrophic injury. Named a Texas SuperLawyer 15 times and to the National Trial Lawyers Top 25 Brain Injury Lawyers, Kern has developed a reputation for going above and beyond in the representation of clients who need him to tell their story. In one brain injury case, Kern lived with his client for three days in order to experience first hand the ways the injury had affected their ability to perform routine daily activities. The jury verdict in that case set a record for the largest verdict ever awarded in that court.

Kern is a 1983 graduate of Abilene Christian University (BBA - Finance) and a 1986 graduate of the Texas Tech University School of Law. At Tech, Kern was the winner and best oralist of the school's Moot Court Competition and selected to represent the school on its National Mock Trial and State Moot Court competition teams. He was also selected by his class to deliver the graduation address. After law school he was was thrown immediately into an active trial practice for a defense firm that represented insurance companies. He then moved to a large commercial litigation firm and developed a products liability practice. In 1992 he formed his own firm to focus on representing injured victims of other people's negligence. In 2016 he joined Dallas legendary trial lawyer Frank Branson in representing victims of catastrophic injuries and in 2020 he joined Bailey & Galyen as Director of the firm's Catastrophic Injury section.

Kern has recovered significant verdicts and settlements for his clients, including a $24,750,000 products liability settlement ($14,787,020 net to client after medical liens, fees and expenses); a $7,500,000 trucking death settlement ($4,473,372 net to client after medical liens, fees and expenses); a $5,185,000 jury verdict in a brain injury / trucking accident ($3,073,000 net to client after medical liens, fees and expenses); a $4,000,000 settlement for back injury case ($2,371,250 net to client after medical liens, fees and expenses) and a $2,500,000 medical negligence settlement ($1,500,000 net to client after medical liens, fees and expenses).

Kern is double Board Certified in Civil Trial Law and Consumer and Commercial Law (products liability) by the Texas Board of Legal Specialization and has the highest possible rating for legal ability and ethics from Martindale - Hubbell. He holds the rank of Associate in the American Board of Trial Advocates (ABOTA).
